An industrial accident is one that occurs as a result of or in the course of work. Jurisprudence has established that a work-related accident is characterized by the occurrence of an accidental event linked to work, which causes an injury. The injury may be physical or psychological. Whatever the origin of the injury (whether caused by the employee himself or by external factors), the employee's state of health must in all cases be medically established.
The occupational nature of an accident is determined by the existence of a direct link between the accident and work. Thus, an accident at work is one that occurs at a time and place when the employee is under the control and authority of the employer, during the performance of the employment contract.
As soon as the CPAM is aware of the accident, it informs the labour inspector and investigates the case. It has 30 days from the date of receipt of the accident report to either rule on the occupational nature of the accident, or to initiate investigations.
